ALTAYLI: FREEDOM OF SPEECH
In his defense, Altaylı stated that his post fell under the scope of freedom of expression and that he did not accept the charges.
However, the indictment emphasized that, based on the case law of the European Court of Human Rights, the Constitutional Court, and local courts, Altaylı’s post constituted a clear offense of “insult” against the victims, going beyond the scope of freedom of the press and the right to criticize.
The indictment stated that the remarks made by Altaylı were of a nature that could offend the victims and undermine their honor, dignity, and reputation.
In the indictment accepted by the 61st Criminal Court of First Instance in Ankara, a prison sentence of six months to four years was sought for Fatih Altaylı.
