The glass will be cleaned first!
Absolute nullity is not a financial (economic) matter; it is a property matter, that is, a matter of public order.
This concept, which is frequently encountered in the legal literature with examples such as marriages performed without a marriage officiant and contracts without notarization, has also been brought to the political scene by Özel-Ekrem A.Ş. I must give them credit; they have really accomplished a difficult task (!).
However, structures that evaluate everything on the axis of money and power continue to commit the same mistakes with the same mentality. At this point, there is not a mistake, but a deliberate wrongdoing and even a de facto rebellion against the rule of law.
The basic logic of this understanding is this:
“What's done is done, so what?”
In any case, late fees are paid, compensation is paid, somehow the matter is closed...
This is not how matters of public order work.
Some deficiencies can be remedied later; however, there are some defects that cannot be remedied later. This is where Absolute Nullity as a legal norm comes into play.
Let's take a simple example:
Your father, the king, has died. You are the youngest prince and your older brother has taken the throne. After many years, it becomes legally and scientifically clear that this person is not the king's son and therefore not your older brother.
In this case, you are the true and legitimate heir to the throne.
So the one who sits on the throne comes out:
“Never mind, what's done is done. Let's not break the order.”
and he says, "I'm not going to do it," do you agree to that?
Should the law condone it?
Should it legitimize the usurpation of rights when the rightful owner is obvious?
This is precisely the issue we face today.
How the delegates were determined has become public knowledge through notary declarations, visual and written media records and various confessions.
And yet some people come out:
“It's over, what's done is done, don't muddy the waters,” he says.
For God's sake tell me:
Where is the law in that?
Where is the conscience in that?
How is that justice?
The law does not interfere in a proper election; it never has.
But this is not an irregularity that can be ignored.
For anyone who does not have a forbidden food in his mouth, this issue is like a fishbone caught in the throat.
Absolute nullity decision is a whole with its reasons, grounds and consequences.
Moreover, the circumstances that led to this decision have not disappeared.
Even before the administration whose rights have been restored has taken its seat, it is attempting to organize another race with the same disputed delegates. With all due respect, no way!
Unless the delegates for sale are cleared and doped horses are taken off the track, this racetrack cannot be opened for racing.
First the sewage will be drained.
Then the glass will be washed.
Only then is water to be drunk.
A drop of dirt in a glass of water may not be a problem for some.
It's happening for us.
Because we are not used to drinking water from dirty glasses.
And we didn't try to pollute.
But who is up to what is no longer a secret.
Ultimately, there is an unchanging truth:
“Out with the soul, in with the temper!”.
You will be patient.
You will be patient until you die.
Maybe it will be a little late...
But it'll be clean.
