Critical decision from the Court of Appeal in CHP's nullity case: ‘Rejection’ decision overturned ‘procedurally’

The 4th Civil Chamber of the Ankara Regional Court of Appeals completed the examination of the lawsuit filed for the annulment of the CHP Istanbul Ordinary Provincial Congress dated October 8, 2023 and the 38th Ordinary Congress dated November 4-5, 2023, which was rejected by the Ankara 3rd Civil Court of First Instance. While the decision to dismiss the case was not reversed, the file was sent to the local court for the elimination of procedural deficiencies.

 

In the decision of the appeal, it was stated that the local court violated the “right to be heard legally” during the trial process and noted the following:

Rejection of Excuse: Despite the valid medical report submitted by the plaintiff's attorney on the day of the hearing, his excuse was not accepted and the decision was rendered in his absence.

Making a Decision Before the Deadline: It was stated that it was irregular to finalize the case at the preliminary examination hearing before the two-week deadline for the parties to submit their evidence expired.”
