In today's economic climate, the most valuable asset of a brand is not the numbers in its bank accounts, but its reputation in the minds of consumers. This reputation, which is built with years of hard work, quality and originality, unfortunately whets the appetite of imitators looking for a \u201cquick profit\u201d. Logo imitation, plagiarism and taking unfair advantage of someone else's reputation are not only a commercial shame, but also serious crimes with severe sanctions in the Turkish legal system.<\/p>\n
Copying the logo, name or distinctive colors of a trademark exposes the consumer to \u201clikelihood of confusion\u201d. The Industrial Property Law No. 6769 (IPL) explicitly prohibits this.<\/p>\n
Legal Sanctions:<\/strong> The person whose trademark right has been infringed may request that the act be stopped, a confiscation order be issued and material \/ moral compensation be paid.<\/p>\n Criminal Sanctions:<\/strong> A person who produces goods or provides services by infringing the trademark right of another person through quotation or confusion may be sentenced to imprisonment from 1 year to 3 years and a judicial fine up to twenty thousand days.<\/p>\n Plagiarism is presenting all or part of a work (writing, design, project) as one's own work without attribution. This situation is evaluated within the scope of the Law No. 5846 on Intellectual and Artistic Works (FSEK).<\/p>\n Violation of Moral Rights:<\/strong> Not acknowledging the author's name or publishing the work in a modified form is an attack on the most fundamental right of the creator.<\/p>\n Sanction:<\/strong> In the case of plagiarism, in addition to lawsuits for restitution of ill-gotten gains and high damages, periodicals are obliged to publish a correction (retraction).<\/p>\n Sometimes a brand is not imitated verbatim, but its public recognition is used as a \u201cparasite\u201d. This is called \u201creputation exploitation\u201d in law. According to the Turkish Commercial Code (TCC), this is a form of unfair competition against the rule of honesty.<\/p>\n Important Note<\/strong> It is one of the greatest breaches of commercial ethics for a business to take advantage of a competitor's customer base or brand equity.<\/p>\n Stealing someone else's logo or idea is not just confiscating an image; it is stealing the trust behind that image. Our legal system is getting tougher and tougher in its shields against \u201clabor theft\u201d. It should not be forgotten that an authentic future cannot be built by photocopying someone else's success story.<\/p>\n Unfortunately, the speed and convenience of the digital age can also make it tempting to copy. But true success is not in imitation, but in creating something new. The future will be built on bold and original ideas, not memorized formulas. The pride of creating and protecting your own brand, your own creation, is a source of satisfaction that imitation can never offer.
