Ancak bu tart\u0131\u015fmay\u0131 yaln\u0131zca g\u00fcncel siyasetin ola\u011fan gerilimleri i\u00e7inde de\u011ferlendirmek yeterli de\u011fildir. \u00c7\u00fcnk\u00fc mesele, bir parti i\u00e7i g\u00fc\u00e7 m\u00fccadelesinden \u00e7ok daha derinde, demokratik temsilin hangi ko\u015fullarda me\u015fru say\u0131laca\u011f\u0131 ve hukuk d\u00fczeninin serbest siyasal iradeyi hangi s\u0131n\u0131rda koruma alt\u0131na ald\u0131\u011f\u0131 sorusuna temas etmektedir.<\/p>\n<p style=\"text-align: justify;\">Nitekim \u201cCHP kurultay davas\u0131\u201d olarak an\u0131lan s\u00fcre\u00e7, b\u00fct\u00fcn\u00fcyle d\u0131\u015far\u0131dan kurgulanm\u0131\u015f bir siyasi kriz anlat\u0131s\u0131ndan ziyade, kurultay s\u00fcrecinin kendi i\u00e7inden do\u011fan iddialar\u0131n g\u00f6r\u00fcn\u00fcr hale gelmesiyle yarg\u0131 \u00f6n\u00fcne ta\u015f\u0131nm\u0131\u015ft\u0131r. Kurultay devam ederken delegeler aras\u0131nda y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc ileri s\u00fcr\u00fclen temaslar, oy tercihlerine etki etmeye d\u00f6n\u00fck giri\u015fimler ve baz\u0131 iddialarda yer alan menfaat ili\u015fkileri kamuoyuna yans\u0131m\u0131\u015f; s\u00fcre\u00e7 yaln\u0131zca siyasal akt\u00f6rler aras\u0131nda de\u011fil, gazeteciler ve parti i\u00e7i \u00e7evrelerde de tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Bu nedenle mesele, d\u0131\u015far\u0131dan in\u015fa edilmi\u015f bir m\u00fchendislikten \u00e7ok, kendi dinamikleri i\u00e7inde geli\u015fen organik bir temsil krizidir.<\/p>\n<p style=\"text-align: justify;\">Tam da bu noktada tart\u0131\u015fma siyasal d\u00fczlemden \u00e7\u0131karak hukuk\u00ee bir mahiyet kazan\u0131r. \u00c7\u00fcnk\u00fc demokratik temsil, yaln\u0131zca sand\u0131\u011f\u0131n kurulmas\u0131yla de\u011fil, sand\u0131ktan \u00e7\u0131kan iradenin \u00f6zg\u00fcr, e\u015fit ve d\u0131\u015f m\u00fcdahalelerden ar\u0131nm\u0131\u015f bi\u00e7imde olu\u015fmas\u0131yla anlam kazan\u0131r. \u0130radenin olu\u015fum s\u00fcrecine y\u00f6nelik sistematik m\u00fcdahaleler, yaln\u0131zca sonucu de\u011fil, do\u011frudan me\u015fruiyetin kurucu zeminini tart\u0131\u015fmal\u0131 hale getirir.<\/p>\n<p style=\"text-align: justify;\">Bu \u00e7er\u00e7evede T\u00fcrk medeni hukukundaki \u201cbutlan\u201d kurumu, yaln\u0131zca teknik bir ge\u00e7ersizlik rejimi de\u011fil, hukuk d\u00fczeninin hangi iradeleri tan\u0131yaca\u011f\u0131na ili\u015fkin kurucu bir e\u015fik olarak devreye girer.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Modern hukuk d\u00fczenleri \u00e7o\u011fu zaman kendilerini normlar\u0131n teknik bir organizasyonu olarak sunar. Oysa hukuk, yaln\u0131zca kurallar b\u00fct\u00fcn\u00fc de\u011fil; hangi iradenin me\u015fru kabul edilece\u011fini, hangi fiillerin korunaca\u011f\u0131n\u0131 ve hangi s\u0131n\u0131rlar\u0131n a\u015f\u0131lamayaca\u011f\u0131n\u0131 belirleyen kurucu bir me\u015fruiyet rejimidir. Bu nedenle hukuk d\u00fczenleri, baz\u0131 hukuka ayk\u0131r\u0131l\u0131klar\u0131 s\u0131radan ihlal olarak de\u011ferlendirirken, baz\u0131lar\u0131n\u0131 do\u011frudan kendi varl\u0131k ko\u015fullar\u0131na y\u00f6nelmi\u015f bir tehdit olarak kabul eder. T\u00fcrk medeni hukukundaki \u201cbutlan\u201d kurumu, i\u015fte bu ikinci alan\u0131n \u00fcr\u00fcn\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk medeni hukukunda butlan, bir hukuki i\u015flemin hukuk d\u00fczeni taraf\u0131ndan ba\u015ftan itibaren ge\u00e7erli bir i\u015flem olarak kabul edilmesini engelleyen a\u011f\u0131r ve giderilemez sakatl\u0131k h\u00e2llerini ifade eder. Butlan\u0131n temelinde, hukuki i\u015flemin yaln\u0131zca taraf iradeleri bak\u0131m\u0131ndan de\u011fil, ayn\u0131 zamanda hukuk d\u00fczeninin korumay\u0131 ama\u00e7lad\u0131\u011f\u0131 kamu d\u00fczeni, genel ahlak, ki\u015filik haklar\u0131 ve emredici normlarla kurdu\u011fu ili\u015fkinin bulunmas\u0131 yatmaktad\u0131r. Bu nedenle butlan, basit bir \u015fekil eksikli\u011fi veya sonradan giderilebilir bir usul kusurundan farkl\u0131 olarak, hukuk d\u00fczeninin i\u015flem \u00fczerindeki kurucu reddini ifade eden a\u011f\u0131r bir ge\u00e7ersizlik t\u00fcr\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk hukukunda butlan\u0131n normatif zemini ba\u015fta T\u00fcrk Medeni Kanunu ve T\u00fcrk Bor\u00e7lar Kanunu h\u00fck\u00fcmlerinde ortaya \u00e7\u0131kmaktad\u0131r. \u00d6zellikle T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 27. maddesi uyar\u0131nca kanunun emredici h\u00fck\u00fcmlerine, ahlaka, kamu d\u00fczenine ve ki\u015filik haklar\u0131na ayk\u0131r\u0131 i\u015flemler kesin h\u00fck\u00fcms\u00fcz kabul edilmektedir. Bu d\u00fczenleme, butlan\u0131n yaln\u0131zca teknik bir \u00f6zel hukuk meselesi olmad\u0131\u011f\u0131n\u0131; hukuk d\u00fczeninin kendi kurucu de\u011ferlerini koruma refleksinin bir sonucu oldu\u011funu g\u00f6stermektedir. Ayn\u0131 \u015fekilde T\u00fcrk Medeni Kanunu\u2019nun d\u00fcr\u00fcstl\u00fck kural\u0131na, hakk\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131n\u0131n yasaklanmas\u0131na ve ki\u015filik haklar\u0131n\u0131n korunmas\u0131na ili\u015fkin h\u00fck\u00fcmleri de hukuk d\u00fczeninin yaln\u0131zca bi\u00e7imsel irade a\u00e7\u0131klamalar\u0131n\u0131 de\u011fil, me\u015fru ve korunabilir iradeleri himaye etti\u011fini ortaya koymaktad\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Bu \u00e7er\u00e7evede butlan, bir hukuki i\u015flemin kurulu\u015f a\u015famas\u0131nda, kurucu unsurlar\u0131nda veya do\u011furdu\u011fu sonu\u00e7larda kamu d\u00fczeni bak\u0131m\u0131ndan kabul edilmesi m\u00fcmk\u00fcn olmayan a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar\u0131n bulunmas\u0131 h\u00e2linde ortaya \u00e7\u0131kar. Burada s\u00f6z konusu olan sakatl\u0131k, i\u015flemin tali veya d\u0131\u015fsal bir unsurunda de\u011fil; do\u011frudan i\u015flem iradesinin hukuk d\u00fczenince tan\u0131nabilir niteli\u011finde meydana gelen bir bozulmad\u0131r. Bu nedenle kesin h\u00fck\u00fcms\u00fczl\u00fckle malul bir i\u015flem, sonradan taraf iradeleriyle, zaman\u0131n ge\u00e7mesiyle veya fiil\u00ee uygulamalarla ge\u00e7erli h\u00e2le gelemez. \u00c7\u00fcnk\u00fc hukuk d\u00fczeni, b\u00f6yle bir i\u015flemi ba\u015ftan itibaren me\u015fru bir hukuki i\u015flem olarak kabul etmemektedir.<\/p>\n<p style=\"text-align: justify;\">Nitekim butlan\u0131n kamu d\u00fczeniyle olan ili\u015fkisi tam da bu noktada g\u00f6r\u00fcn\u00fcr h\u00e2le gelir. Kamu d\u00fczeni yaln\u0131zca devletin idar\u00ee veya siyasal g\u00fcvenli\u011fini ifade eden dar bir kavram de\u011fildir; toplumun temel hukuk\u00ee, ahl\u00e2k\u00ee ve anayasal yap\u0131s\u0131n\u0131 koruyan kurucu normatif alan\u0131 ifade eder. Hukuk d\u00fczeni baz\u0131 hukuki i\u015flemleri bireylerin serbest iradesine b\u0131raksa da belirli s\u0131n\u0131rlar\u0131n a\u015f\u0131lmas\u0131 h\u00e2linde art\u0131k bireysel menfaatleri de\u011fil, do\u011frudan toplumsal d\u00fczeni ve ortak hukuk\u00ee yap\u0131y\u0131 koruma refleksi g\u00f6sterir. Bu nedenle kamu d\u00fczenine ayk\u0131r\u0131 i\u015flemler, yaln\u0131zca taraflar bak\u0131m\u0131ndan sak\u0131ncal\u0131 kabul edilmez; ayn\u0131 zamanda hukuk d\u00fczeninin varl\u0131k ko\u015fullar\u0131na y\u00f6nelen tehditler olarak de\u011ferlendirilir.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk hukukunda hukuka ayk\u0131r\u0131l\u0131k kavram\u0131 da yaln\u0131zca pozitif normlara bi\u00e7imsel ayk\u0131r\u0131l\u0131kla s\u0131n\u0131rl\u0131 de\u011fildir. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun a\u00e7\u0131k d\u00fczenlemesi uyar\u0131nca ahlaka ayk\u0131r\u0131l\u0131k da kesin h\u00fck\u00fcms\u00fczl\u00fck sebebi olarak kabul edilmektedir. B\u00f6ylece T\u00fcrk \u00f6zel hukuku, hukuk ile ahlak aras\u0131nda mutlak bir kopu\u015f \u00f6ng\u00f6rmemekte; belirli yo\u011funlu\u011fa ula\u015fan ahlaki ayk\u0131r\u0131l\u0131klar\u0131 ayn\u0131 zamanda hukuk d\u00fczenine y\u00f6nelik ihlaller olarak de\u011ferlendirmektedir. \u0130nsan onurunu zedeleyen, ki\u015fili\u011fi ara\u00e7salla\u015ft\u0131ran, s\u00f6m\u00fcr\u00fc ili\u015fkisi yaratan veya toplumsal etik d\u00fczeni a\u011f\u0131r bi\u00e7imde ihlal eden i\u015flemler yaln\u0131zca ahlaken problemli de\u011fil, hukuken de ge\u00e7ersiz kabul edilmektedir. Bu yakla\u015f\u0131m\u0131n anayasal zemini de bulunmaktad\u0131r. T\u00fcrkiye Cumhuriyeti Anayasas\u0131\u2019n\u0131n insan onuru, hukuk devleti, demokratik devlet ve temel haklar\u0131n korunmas\u0131na ili\u015fkin h\u00fck\u00fcmleri, \u00f6zel hukuk ili\u015fkilerine y\u00f6n veren \u00fcst normatif \u00e7er\u00e7eveyi olu\u015fturur.<\/p>\n<p>&nbsp;<\/p>\n<p>Bu genel hukuki \u00e7er\u00e7eve, siyasal partilerin i\u00e7 i\u015fleyi\u015fi ve karar organlar\u0131n\u0131n olu\u015fumu bak\u0131m\u0131ndan da do\u011frudan \u00f6nem ta\u015f\u0131r. \u00c7\u00fcnk\u00fc siyasal partiler, modern demokratik hukuk devletinde yaln\u0131zca s\u0131radan \u00f6zel hukuk t\u00fczel ki\u015fileri veya ola\u011fan sivil toplum \u00f6rg\u00fctleri de\u011fildir. Aksine siyasi partiler, anayasal d\u00fczenin olu\u015fumuna do\u011frudan kat\u0131lan, demokratik temsil mekanizmas\u0131n\u0131n i\u015flerli\u011fini sa\u011flayan ve kamusal iradenin te\u015fekk\u00fcl\u00fcnde kurucu rol oynayan anayasal yap\u0131lard\u0131r. Nitekim Anayasa\u2019n\u0131n siyasi partileri demokratik siyasal hayat\u0131n vazge\u00e7ilmez unsurlar\u0131 olarak tan\u0131mlamas\u0131 da bu nedenle \u00f6nemlidir.<\/p>\n<p>Dolay\u0131s\u0131yla siyasi partilerin genel kurul, kongre ve karar organlar\u0131na ili\u015fkin se\u00e7im s\u00fcre\u00e7leri yaln\u0131zca teknik organizasyon faaliyetleri olarak de\u011ferlendirilemez. Bu s\u00fcre\u00e7lerin demokratik rekabet, se\u00e7im g\u00fcvenli\u011fi, e\u015fitlik, \u015feffafl\u0131k, d\u00fcr\u00fcstl\u00fck ve serbest irade ilkelerine uygun bi\u00e7imde y\u00fcr\u00fct\u00fclmesi anayasal me\u015fruiyetin zorunlu bir sonucudur. Demokratik temsilin me\u015fruiyeti yaln\u0131zca \u015feklen se\u00e7im yap\u0131lmas\u0131na de\u011fil, se\u00e7men iradesinin bask\u0131dan, manip\u00fclasyondan, organize y\u00f6nlendirmelerden ve hukuka ayk\u0131r\u0131 m\u00fcdahalelerden ar\u0131nm\u0131\u015f bi\u00e7imde ortaya \u00e7\u0131kmas\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n<p>\u00d6zellikle delegelerin veya se\u00e7menlerin iradesini organize bi\u00e7imde y\u00f6nlendirmeye, bask\u0131 alt\u0131na almaya, menfaat ili\u015fkileriyle manip\u00fcle etmeye ya da se\u00e7im sonucunu hukuka ayk\u0131r\u0131 y\u00f6ntemlerle belirlemeye y\u00f6nelik giri\u015fimler, yaln\u0131zca parti i\u00e7i disiplin sorunu olarak g\u00f6r\u00fclemez. Bu t\u00fcr m\u00fcdahaleler, demokratik temsil mekanizmas\u0131n\u0131n kurucu me\u015fruiyetini ortadan kald\u0131ran a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar niteli\u011findedir. \u00c7\u00fcnk\u00fc demokratik se\u00e7im, yaln\u0131zca teknik bir oylama prosed\u00fcr\u00fc de\u011fil; hukuk d\u00fczeninin korudu\u011fu serbest siyasal irade ilkesinin somutla\u015fm\u0131\u015f bi\u00e7imidir.<\/p>\n<p>Bu ba\u011flamda demokratik se\u00e7im iradesini ortadan kald\u0131ran organize m\u00fcdahalelerle \u015fekillenmi\u015f bir se\u00e7im s\u00fcrecinin hukuk d\u00fczeni taraf\u0131ndan korunmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Buradaki hukuka ayk\u0131r\u0131l\u0131k, se\u00e7im s\u00fcrecinin sonradan giderilebilir tali bir eksikli\u011finden ibaret olmay\u0131p do\u011frudan iradenin te\u015fekk\u00fcl\u00fcne ve demokratik me\u015fruiyetin kurucu unsuruna ili\u015fkindir. Dolay\u0131s\u0131yla demokratik rekabeti ortadan kald\u0131ran, se\u00e7im e\u015fitli\u011fini bozan veya se\u00e7men iradesini organize bi\u00e7imde sakatlayan y\u00f6ntemlerle elde edilen makamlar hukuken korunabilir me\u015fru stat\u00fcler olarak de\u011ferlendirilemez.<\/p>\n<p style=\"text-align: justify;\">Aksi y\u00f6ndeki bir yakla\u015f\u0131m, hukuk d\u00fczeninin kendi kurucu ilkeleriyle \u00e7eli\u015fmesi sonucunu do\u011furur. \u00c7\u00fcnk\u00fc hukuk devleti yaln\u0131zca sonu\u00e7lar\u0131 de\u011fil, o sonu\u00e7lar\u0131n elde edilme bi\u00e7imini de me\u015fru kabul eden normatif bir d\u00fczendir. E\u011fer hukuk d\u00fczeni, demokratik iradeyi sistematik bi\u00e7imde sakatlayan s\u00fcre\u00e7ler sonucunda elde edilen siyasal makamlar\u0131 ge\u00e7erli sayarsa, bu durumda hukuk kendi me\u015fruiyet temelini ink\u00e2r etmi\u015f olur.<\/p>\n<p style=\"text-align: justify;\">Dolay\u0131s\u0131yla siyasi parti organlar\u0131n\u0131n olu\u015fum s\u00fcre\u00e7lerinde ortaya \u00e7\u0131kan a\u011f\u0131r ve organize irade sakatl\u0131klar\u0131, T\u00fcrk medeni hukukunun butlan rejimi kapsam\u0131nda de\u011ferlendirilmesi gereken kamu d\u00fczeni sorunlar\u0131d\u0131r. Demokratik me\u015fruiyeti ortadan kald\u0131ran y\u00f6ntemlerle olu\u015fmu\u015f bir iradenin hukuk d\u00fczeni taraf\u0131ndan korunmas\u0131, hem T\u00fcrk Medeni Kanunu ve T\u00fcrk Bor\u00e7lar Kanunu\u2019nun emredici h\u00fck\u00fcmleriyle hem de anayasal demokratik d\u00fczenin temel ilkeleriyle ba\u011fda\u015fmaz.<\/p>\n<p style=\"text-align: justify;\">Son kertede mesele, yaln\u0131zca bir siyasi partinin i\u00e7 i\u015fleyi\u015finde ortaya \u00e7\u0131kan usuls\u00fczl\u00fckler de\u011fildir. As\u0131l mesele, demokratik temsilin hangi ko\u015fullarda me\u015fru say\u0131laca\u011f\u0131 ve hukuk d\u00fczeninin kendi kurucu ilkelerini hangi noktada koruyaca\u011f\u0131d\u0131r. Zira demokratik hukuk devleti, yaln\u0131zca se\u00e7im sonu\u00e7lar\u0131n\u0131 de\u011fil, o sonu\u00e7lar\u0131 do\u011furan iradenin olu\u015fum ko\u015fullar\u0131n\u0131 da korumak zorundad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu nedenle butlan kurumu burada yaln\u0131zca teknik bir ge\u00e7ersizlik yapt\u0131r\u0131m\u0131 de\u011fil, hukuk d\u00fczeninin kendisini yeniden kurma ve koruma mekanizmas\u0131d\u0131r. Kesin h\u00fck\u00fcms\u00fczl\u00fck, hukuk d\u00fczeninin belirli fiil\u00eelik bi\u00e7imlerine y\u00f6neltti\u011fi kurucu reddi ifade eder. Hukuk baz\u0131 sakatl\u0131klar\u0131 sonradan giderilebilir kabul edebilir; ancak demokratik iradenin olu\u015fumunu ortadan kald\u0131ran a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar bak\u0131m\u0131ndan ayn\u0131 tolerans\u0131 g\u00f6steremez.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00c7\u00fcnk\u00fc bazen hukuk yaln\u0131zca d\u00fczen kurmaz; ayn\u0131 zamanda s\u0131n\u0131r \u00e7izer.
